Diplomatic Missions and Foreign Offices (DMFOs) and their eligible staff members must obtain prior approval from the Ministry of Foreign Affairs (MOFA) of the R.O.C. (Taiwan) before employing foreign nationals, pursuant to Article 49 of the Employment Service Act. Employment shall be subject to the principle of reciprocity.
The categories covered in this chapter include locally employed foreign staff, private servants, foreign domestic workers, as well as work permits for eligible family members of DMFO staff members.
Important Notes Regarding Employment Visas:
DMFOs and their eligible staff members should ensure that their employees obtain and hold the appropriate visa following MOFA’s issuance of a work permit, depending on the circumstances:
1. Employees entering Taiwan for the first time to work for a DMFO shall, upon approval of the work permit, apply for the relevant visa accordingly.
2. Employees already in Taiwan transferring from non-DMFO employers, including private companies or other organizations, must, once a new work permit has been granted, depart Taiwan and obtain the required visa at an R.O.C. embassy or mission abroad prior to re-entering Taiwan for employment at a DMFO.
3. Employees transferring to or renewing employment at a DMFO in Taiwan may, with the new work permit, replace their existing ARC with a new one through the National Immigration Agency (NIA).
